Question:
We live in the Northern part of Canada where Isha time is so short during summer that in June, midnight passes while it is still Maghrib time. It is the consensus of Ummah that the duration of the Isha time remains till dawn. However, some people here, especially women who conduct religious gatherings, say that the Isha time ends at midnight (Sharai Midnight), and therefore, Isha becomes Qaza after it. They also present Hadith as proof of their claim. My question is regarding the status of their evidence, whether it is a hadith, or a saying or an action of Sahabah Kiraam رضى الله عنهم or if it is deduced by Ijma?
B). Under the same context, Maghrib time during summer is very long. According to calculations, midnight passes when Maghrib is still active. Meaning that the “Shafaq al Ahmar” (red twilight) and “Shafaq al Abyad” (white twilight) are still visible in the sky when midnight passes and after that complete darkness spreads and the time of Isha enters. Now, wouldn't it be safe to say that in this situation praying Isha after midnight would not be even makrooh as the time for Isha entered only after the midnight occured. Is this correct?
ہم کینڈا کے شمال میں رہتے ہیں اور یہاں عشاء کا وقت بہت کم ہوتا ہے۔ چونکہ عشاء کا آخری وقت جس پر آئمہ کا اتفاق ہے کہ عشاء کا وقت صبح صادق سے نکلنے سے پہلے تک رہتا ہے۔ مگر یہاں کچھ لوگ اور خاص طور پر خواتین میں یہ جو کہتے ہیں کہ عشاء کا وقت آدھی رات کے بعد ختم ہو جاتا ہے اور نماز قضا ہو جاتی ہے اور اسکی دلیل حدیث سے دیتے ہیں۔ یہاں گرمیوں میں عشاء کا وقت بہت کم ہوتا ہے اور جون کے مہینے میں آدھی رات ہی اکثر مغرب کے وقت گزر جاتی ہے۔ سوال یہ ہے کہ یہ جو لوگ عشاء کے آدھی رات پر ختم ہونے کے قائل ہیں انکے پاس جو دلیل ہے وہ کیا ہے جس سے وہ استدلال کرتے ہیں؟ کیا وہ حدیث ہے یا صحابہ کرام رضی اللہ عنہم کا قول یا عمل ہے یا اجماع ہے؟

ب)۔ اسی ضمن میں سوال یہ ہے کہ یہاں پر مغرب کا وقت بہت ہی لمبا ہوتا ہے۔ حساب کے مطابق آدھی رات مغرب کے دوران ہی آجاتی ہے ، مطلب کہ شفق احمر بھی ہوتی ہے اور شفق ابیض بھی ہوتی ہے اور رات کا درمیانی حصہ اُسی میں آجاتا ہے اور بعد میں تاریکی ہوتی ہے اور عشاء کا وقت آجاتا ہے۔ تو اس صورت میں تو عشاء کا مکروہ وقت بھی نہیں ہوگا کیونکہ عشاء کا وقت داخل ہی آدھی رات کے بعد ہوتا ہے۔ کیا یہ درست ہے؟
